Difficulties And Countermeasures Of The Complaint Petition System

Complaint Petition is an important part of the system,which refers to the activities in which the litigants or relevant interested parties make appeals to the procuratorial organs,and the procuratorial organs handle them in accordance with law.Along with the rapid development of the economy,the increase of market transactions,a large number of contradictions and disputes in the form of cases enter into the judicial field.The procuratorial agency,as one of the national legal supervision institutions,has faced a high incidence of petition cases.Complaint Petition system ensures civil rights which are infringed upon to obtain an effective relief channels,at the same time,leads to a series of problems such as unrealistic appeals,intertwined legal methods and extralegal settlements and unfinished cases.How to improve complaint petition system and effectively solve the above problems while protecting the right of the complainants to express their opinions,is not only a problem urgently to be solved by the procuratorial agency,but also a focus of social concern in the field of public governance.Based on the present situation of complaint petition system,this paper studies it’s existing problems and improvements.The paper firstly clarify the concept and relationship of the related petition types.Secondly,this paper analyzes the data of complaint cases received by procuratorial organs in recent years,and summarizes the status of the complaint petition in China.Thirdly,from the three aspects of the current situation,this paper analyzes the practical difficulties and system defects of complaint petition.Finally,from the perspective of the system problems of procuratorial organs and the complainants themselves,this paper explores the deep-seated causes of the predicament,so as to have a comprehensive and profound understanding of the complaint petition.On this basis,this paper puts forward the reform conception of the system,and emphasizes the necessity of improving and implementing the disposal mechanism of the complaint petition system.In terms of resolving problems,this paper finally advocates the promotion of case handling,the establishment of credibility,the popularity of legal knowledge and the accomplishment of judicial aid.
