Research On Dong Biwu’s Legal Thought

Dong Biwu was one of the most outstanding and important leaders in the early days of the founding of the People’s Republic of China.He was one of the important founders of the rule of law in the new China.He pursued the rule of law in his life,emphasized the important value of law in national construction and social governance,and passed legislation.Thoughts such as judiciary,law enforcement,and law-abiding have made important contributions to the construction of a new rule of law society in New China.This research adopts the research methods such as literature research method,historical research method and comprehensive analysis method.Through the combing and summarization of Dong Biwu’s related works,it elaborates on Dong Biwu’s rule of law thought,in order to benefit the construction of contemporary rule of law society.The research is divided into five parts: The first part is the foreword,which briefly describes the basis of the topic,the research status,research ideas,research methods,research innovations and deficiencies.The second part is the formation of Dong Biwu’s legal thought.Through the brief introduction of Dong Biwu’s life and academic experience,this paper analyzes the background,theoretical basis and practical conditions of Dong Biwu’s legal thought.The third part is the main content of Dong Biwu’s legal thought.The legislative thinking,judicial thinking,law enforcement thinking and law-abiding thoughts are discussed.Legislation must be based on the actual level of the state and society.In simple terms,legislation should be based on practice.The law is like a perfect building,but this building cannot be a castle in the air.There must be a very strong foundation to stabilize the building.The basis for starting from practice is the solid foundation of the law as a skyscraper.At the level of judicial operation,we must fully consider the unique historical value of our country,and we must also consider the interaction between the old and new legal systems.China is a big country with a long history.In the 5,000-year civilization,there are many laws and regulations of the old times.At the level of judicial operation,we must pay attention to the influence of the laws of the old era.Law enforcement thinking should have certain strategic thinking and dialectical considerations;it is necessary to pay attention to innovation and law enforcement,but it cannot completely ignore innovation and neglect feasibility.In terms oflaw-abiding,Mr.Dong Biwu believes that government staff should become a model for law-abiding.If civil servants regard law and nothing,then the desire of ordinary citizens to obey the law is tantamount to asking for fish.The fourth part is the construction of the rule of law by Dong Biwu’s socialist rule of law.Revelation,through the elaboration of theoretical value and practical value,from the aspects of legislation,judicature,law enforcement and law-abiding,it discusses the important enlightenment of Dong Biwu’s socialist rule of law on the construction of contemporary rule of law society;the fifth part is the conclusion,by combing the whole text,Analysis conclusion.
