In recent years,the copyright disagreement of audiobooks in the internet setting is a really important problem in the field of Copyright Infringement.The case of the infringement of the right of information network about Xiexin V.Lazyor and other companies is a typical example of Copyright dispute between the copyright holder and audiobook platform due to the unauthorized behaviors.There appears to have four disagreements.Specifically,they refer to what is audiobook in legal paper,what kind of act should be recognized as authorized act,what kind of jointly and severally liable they should take and how much damages they pay.How to define the audiobooks in the legal papers is based on whether the involved contents have original parts and these parts must have been protected in Copyright Law or not.The first situation is that the involved contents have original parts and have been protected in Copyright Law,we could consider the audiobooks as creative works.And the second situation is that the audiobooks just change the form of works,they have no original parts or the original parts haven't been protected,so we regard this kind of audiobook as the phonogram.The audiobooks of the case in the paper should be considered as the phonograms for the involved audiobook is the duplicate of the work and has no original contents.What about the authorized acts,the behavior of Lazyor and other companies,refer to behavior of authoring under unauthorized situation is forbidden in Copyright Law for they had tort.And the jointly and severally liable of the case,four companies should liable for tort.Only had the Lazyor tort,others helped it under the unauthorized situation.At last,how much damages they should pay according to the regulations and rules in law paper.
