Legislation And Enlightenment Of EU Subjects' Personal Information Protection

The genocide in the name of scientific research in the Second World War gave birth to the laws and regulations on clinical trial activities after the Second World War,such as Nuremberg Code and Helsinki Declaration.At the same time,the protection of the legal rights and interests of the participants in the clinical trial activities began to attract the attention of the world,which also promoted the concept of the subjects.In addition to putting an end to all kinds of inhuman false "scientific research" activities for people's injurious behavior,the protection of the legitimate rights and interests of the subjects in the legal clinical trial activities also deserves enough attention,because by contrast,the subjects are often in a weak position under the researchers,and the possibility of personal privacy information exposure of the subjects is greatly increased in the trial activities.However,up to now,there is a lack of legislation and social system around the world that focuses on the subjects.Such a lack shows that under the current background of the Internet age,more serious social problems may arise.Nowadays,personal information has become a kind of resource form with strategic significance.The personal information of subjects is more private and important than ordinary personal privacy information.Once such information is illegally disclosed and utilized,it will not only have a very important impact on the life,employment,social interaction and other aspects of the subject,but also may affect the security and development of the country,such as reproductive gene editing against bioethics,scientific ethics,gene editing,baby cloning of human beings and other issues,which may be due to the theft of the subject's genes,life and health information and illegal use,which has a serious impact on the basic value system of the whole human society.Therefore,the author hopes that on the basis of further clarifying the concept of the right of personal information of the subjects,through the research on the relevant legislation of the European Union region which has relatively systematic,in-depth and comprehensive provisions on the protection of personal information of the subjects,we can set up a good template for the development of personal information protection of the subjects or medical field in China.The content framework of this paper is mainly:The first part: the overview of personal information protection of subjects in the European Union.Firstly,the concept of the subject is analyzed and described,and the subject scope of the subject is defined.Secondly,it analyzes the category of the personal information of the subjects and clarifies the specific types of the personal information of the subjects.Thirdly,there are two types of rights related to personal information: personal information right and privacy.The right is analyzed to make clear the right attribute corresponding to the personal information of the subject.Finally,personal letter to EU region.This paper introduces the model of interest protection and the challenges faced by personal information protection,which leads to the following research on the legislation of EU subjects' personal information protection area.The second part: research on the legislation of EU subjects' personal information protection area.This part is the core content of this paper,mainly divided into the following aspects: The overview of EU regional legislative system.This paper mainly introduces the differences between the EU as a National Union and the general national legislation system,so as to make clear how the EU legislation about the behavior of the relevant subjects of the member states in terms of effectiveness.The legislative evolution of the protection of the right to personal information of the subjects in the European Union is briefly introduced.The current legislation on the protection of subjects' personal information rights in the European Union focuses on the protection of subjects' personal information in the general data protection regulations(hereinafter referred to as "GDPR").The third part: the enlightenment of EU subjects' personal information protection area legislation for the improvement of relevant legislation.
