In the field of civil law,the most notable one in 2017 was the enactment of the general principles of the civil law of the People’s Republic of China.Article 185 of the general principles of the civil law of the People’s Republic of China,known as the "heroes" clause,was the most notable one.Based on the analysis of the problem,this paper puts forward some Suggestions on the improvement of the protection of yinglie’s personality rights.Clear the three basic principles of protection of heroic martyrs personality,for our country the legitimate rights and interests of the heroes of the martyrs to fully respect and protect,to properly handle in protection of the citizens’ freedom of all kinds of specific provisions in the constitution in our country and protect heroic martyrs possible conflicts between personality rights,the relationship between the tort to very specific rules need to undertake necessary responsibility and bear the fault phase and its matching punishment;Moreover,the scope of the inherent level of the protection of personality rights and interests such as heroes and martyrs should be specified in the legal provisions.It is necessary to expand the objects protected by the law to include the privacy right of heroes and martyrs and the rights and interests of survivors in the scope that need to be protected.To increase the sanction to the behavior that infringes the personality rights of the hero and discuss the necessity of introducing the appropriate punitive compensation measure;We can appropriately expand the scope of the subject of claims and actively encourage some competent forces existing in our country and society to participate in the litigation.
