Research On The Confirming Of Electronic Evidence From The Perspective Of Intelligent Judicature

In 2015,our country began to make decisions to lay out the national level of big data strategy,in the State Council issued the "Platform for Action to Promote the Development of Big Data" put forward the direction of big data development.As a result,the rule of law in social governance has changed dramatically.Combining with the national strategy of rule of law,the intelligent judicature,which is in line with the background of the new era of data,emerges at the historic moment.In 2019,minister fu zhenghua delivered a speech at the promotion meeting of the ministry of justice on the application of digital rule of law and intelligent judicature,aiming at the modernization ability of intelligent judicature to promote the reform of the country’s judicial system and social governance,demonstrating the country’s determination to promote intelligent judicature.With the rapid development of intelligent judicature,some related problems are emerging and need to be studied and solved.With the rapid development of intelligent judicature,some related problems are emerging and need to be studied and solved.Electronic evidence has only recently become clear in procedural law,but there is still a lot of ambiguity.Now,from the perspective of intelligent justice,there are many new ways to determine electronic evidence,and there will be more situations that have never been encountered before.How can courts explicitly admit electronic evidence rather than ignore its role,and how can electronic evidence be found to reflect its evidentiary character?As one of the links that can best embody intelligent judicature,this paper is to study how to identify electronic evidence from the perspective of intelligent judicature and how to better control the application of intelligent judicature.This paper studies the identification of electronic evidence from the perspective of intelligent judicature.It not only summarizes the current situation of intelligent judicature as a whole,but also focuses on the identification of electronic evidence in the context of this era,especially in the perspective of intelligent judicature.And analyzes and compares the domestic and foreign relevant regulations and the practice in the operation similarities and differences,so as to learn from each other,absorb the foreign excellent experience,avoid the same mistake.During the period of writing this paper,the COVID-19 was rampant.Under this special situation,the judicial system also made correspondingresponse,and the online court hearing came into being and was used in practice.Therefore,in the process of writing,based on the epidemic situation,this paper discusses the role of electronic evidence identification under the support of intelligent judicatory and the difficulties faced by a country in the face of special events,such as SARS and the COVID-19,and other major epidemics.This is a new insight into the reality,but it is really helpless.On the basis of careful study of related problems,this paper also tries to give some Suggestions on improving measures from the perspective of theory and practice.
