| There are complex legal relationships between the project sponsor,the platform,and the project supporter in a reward-based crowdfunding.Under the legal framework in China,there is a certain legal basis for determining the legal relationships of the reward-based crowdfunding.The rights protection cases of some project supporters in practice also involve the legal definition of reward-based crowdfunding.However,according to the analysis of relevant case judges,for now,there is no uniform definition standard.Compared with professional investors,project supporters as ordinary financial consumers have less ability to resist risks,and often do not receive effective relief when their rights and interests are damaged.Coupled with the particularity of Internet finance,China’s "Consumer Rights Protection Law" is difficult to meet the demands of the protection of project supporters.It is necessary to carry out research on the issues related to the protection of the rights and interests of project supporters in reward-based crowdfunding in China.This article attempts to clarify the definition of the legal relationship between the three parties of reward-based crowdfunding.Based on this,a comprehensive analysis of the application of existing laws and regulations and the judgment opinions in practical cases is used to find out the legal dilemma in the protection of the rights of project supporters.Countries such as the United States,Britain,and France have a high degree of development in Internet Finance,and have improved legal regulations and regulatory measures for crowdfunding.By summing up the experience of protecting foreign project supporters and combining with China’s actual situation,this article finally puts forward suggestions on the construction of a project supporter’s rights protection system in reward-based crowdfunding by improving the legal norms ofaward-based crowdfunding and the rights system of project supporters,setting up a liability system for crowdfunding platforms,and establishing a diverse dispute relief mechanism. |
