Research On The Legal Regulation Of Online Second-hand Trading Platform

With the continuous improvement of national economic level and the rapid development of the Internet,online shopping brings convenience to the public,while irrational consumption also comes into being,and individuals cannot handle more second-hand goods.In addition,in sharing the development of the economy and national policy encouragement,fast development of network second-hand trading market in China,more and more people are willing to put personal second-hand goods trading,"break from" more and more become a kind of trend,different kinds of network secondary trading platform arises at the historic moment,which includes the larger "idle nets","walk" and "how to catch fish." Compared with the relatively mature primary e-commerce market,such as taobao,jingdong,PDD,Vipshop,etc.,there are many problems in the order of online second-hand trading market in China,such as product quality problems,user rights protection problems,the breeding of contraband,infringement of knowledge products and other problems emerge one after another.The first chapter of this paper analyzes the legal relationship between various subjects in the process of network second-hand trading.The second chapter puts forward the existing problems and causes of network second-hand trading platform.It mainly includes the product quality problems in the platform,the existence of illegal transactions such as contraband,transaction security problems and the imperfect transaction dispute resolution mechanism.The above problems are mainly caused by the lagging legislation of the second-hand trading market in China,ineffective self-supervision of thesecond-hand trading platform and insufficient administrative supervision of the platform by the government.The third chapter from the legislative principles,government governance,platform responsibility three aspects proposed to improve China's network secondary trading market regulation.
