The Rational Solutions To The Abuse Of Appeal Of Government Information Disclosure

The government information disclosure system plays an important role in establishing the "sunshine government"to guarantee the knowing and supervising right of the citizens.However,the easier the administrative litigation,the more cases of government information disclosure litigation,together with a large number of litigation right abuse by citizens which results injudicial resources consuming.While wasting the public resources,such litigation right abuse also has a negative influence on the government information publicity system,and weakens the judicial authority and credibility.There are many reasons for the abuse of the abuse of appeal of government information disclosure,such as the disunity of the judicial cognizance of litigation abuse,the unclear legal consequence of litigation abuse and the anomie of the behavior in the judicial judgment etc.Hence,the following measures have to be taken to reasonably handle the litigation abuse in the government information disclosure system,to specify the constitutive requirements and legal consequences of litigation abuse,to unify the basis of judicial cognizance,to take the experience of foreign countries as reference,to strengthen the prevention in advance,to improve the procedure control,which shall all be implemented together so as to solve the worres of litigation abuse in the government information disclosure and realize the balance between the protection of litigation rights and the regulation of litigation abuse.
