Research On The Registration System Of Real Estate Trust

Since the beginning of this century,after the promulgation of China’s "Trust Law",the trust industry has entered a period of rapid development.However,the supporting registration system for real estate trusts has not moved,and the relevant trust property has not been properly protected.This article mainly studies the real estate trust registration system through comparative analysis and empirical analysis.This article introduces the basic operation mode of real estate trust and determines the nature of real estate trust registration.Due to the independence of trust property,the legal relationship of trust in real estate must be registered and publicized to reflect the authority of real estate trust registration.Therefore,the trust relationship should be included in the object of real estate trust registration together with the trust property.The registration of the real estate trust relationship is mainly reflected by the purpose of the trust,the duration of the trust,the management method of the trustee,and the scope of rights,etc.At the same time,the trust documents should also be attached for reference.Given that China has basically completed the unified registration system for real estate,on this basis,it is sufficient to add a real estate trust registration window.There is no need to separately establish a real estate trust registration agency.The implementation of the online registration system is also the only way to improve the real estate trust registration system.Subsequently,the author also designed the real estate trust registration procedures accordingly:real estate trust registration applications should use the common application doctrine,real estate trust registration applications and real estate rights registration applications can be used together in the same application,real estate trust registration review Adopt formal review criteria.
