Research On The Standardization Of Making Public Security Criminal Legal Documents

With the modern development of China’s governance system and governance capabilities,the deepening of the reform of the judicial system and the process of standardization of public security law enforcement is also accelerating.To quickly and steadily promote the development of the rule of law in my country,it is not only to guide and strengthen citizens ’awareness of the rule of law,to enhance citizens’ ability to use the law to protect their rights and interests,but also to optimize the layout of reform and clarify the direction of reform for public power organs.Under this trend,law enforcement has become one of the entry points for reform.The public security criminal legal instruments used in law enforcement have aroused widespread concern among scholars in my country.The methods of investigation,methods of handling cases,types of crimes,and methods of crime involved in criminal law documents of public security are constantly changing,and the departmental laws,such as the Criminal Procedure Law,on which they are based are constantly developing in the 21st century.Faced with the constantly changing theoretical basis and practical situation of document production,the author of the public security criminal legal document will cause improper preparation of the public security criminal legal document if he is not careful.Therefore,on the basis of carefully studying the current standard format,the author compares with the previous format version,finds out the underlying logic and reasons for the revision of public security criminal legal documents,and provides more complete and specific directions and guidelines for its further regulation.The first part of the main text introduces the literature review and research methods of this study,trying to find the basis and direction for standardizing the production of public security criminal legal documents through the literature data analysis method,comparative analysis method and case analysis method.The second part introduces the definition and evolution history of public security criminal legal documents.By comparing the format of 1996,2002 and 2012,it draws the law of its continuous development in the direction of practicability,and from different perspectives The paper format is divided into categories.The third part clarifies the unique legal binding significance of the public security criminal legal documents as written evidence for handling cases by refining rich materials,and discusses the necessity and feasibility of standardizing it in combination with historical and practical perspectives.The fourth part analyzes the existing problems of public security criminal legal documents from the practical level through the combination of theory and practice,including the fact that the narrative of the public security criminal legal documents is not properly detailed,the evidence is not properly selected,the reasoning is rigid and obscure,and the formatting is rough.Wait.The fifth part combines the existing system norms,analyzes the problems in the fourth part one by one,and proposes measures for the standardization of the production of public security criminal legal documents in terms of content and format,including the standardization of fact narrative,the standardization of evidence expression,the standardization of reasoning and the standardization of format.In this respect,it also emphasized that improving the legal level of public security criminal legal documents and ensuring the legitimacy of law enforcement subjects will help to improve supporting measures for the standardization of documents.This article elaborates on the far-reaching role of the standardization of public security criminal legal instruments at the national,judicial system,and grassroots level law enforcement personnel.It can be made clear that standardizing them will undoubtedly help promote the construction of a rule of law China.The role of standardizing the production of public security criminal legal documents is not only to improve the level and efficiency of law enforcement,but also to help public security organs establish an authoritative image,highlight the seriousness of the rule of law,and build a regular public security team,but also to use this as a foothold and build a more orderly,A more efficient and healthy society ruled by law.
