In recent years,our food fraud are frequent.From the Swill-Cooked Dirty Oil to the Clenbuterol,from Drug Milk Event to the Tainted Steamed Bun,the whole country are startling,are shocked.Food fraud is our major food safety incidents,including Economically Motivated Adulteration food fraud(EMA)as the main food fraud event.Some of the domestic scholars begin to study food fraud,the State Food and Drug Administration in 2017,introduced the food safety Fraud Investigation Procedures for soliciting opinions,see How to effectively regulate food fraud,in order to maintain market order,and the protection of consumers' right to health and the right to know,has emerged as a common national and social concern and importance to the topic.This article focused mainly on the economic interests of Economically Motivated Adulteration(EMA)administrative regulations to address research,while at the same time as a result of administrative law enforcement and legal legislation,the close relationship between the appropriate balance between discussion of legal regulations.This article is based on the study of comparative studies of European countries and the United States administrative regulations,the EMA practice for comparison and research.The paper is divided into five parts:the first part of the foreword,including research background and significance,and an overview of domestic and international research and research methods.The second part is built around Economically Motivated Adulteration food fraud(EMA)are summarized in this document,including the study of the problem,the definition of the EMA,EMA and other related concepts distinguish between the resolution and relationships.EMA defined from the edge of the EMA as an incentive,the EMA defined analysis.EMA and related concepts is mainly associated with the concept of food fraud,as well as with the concept of food security and unfair competition.The third part is in the analysis of the EMA is based on the concept of the administrative regulations,the necessity of the EMA analysis.From the theoretical and practical levels.The theoretical aspects,mainly food law theory of risk analysis and careful choice theory,as well as the Consumer Protection Act,the consumer's right to know.The real dimensions of the throwing out of the window,empirical data and an overview of the academic data,a comprehensive analysis of the EMA event in China's current food security role and impact,and to present the characteristics of the EMA events are summarized and analyzed.The fourth section focus on comparative studies in Europe and the United States of the EMA administrative practice and on the basis of the analysis,from the history,administrative regulations,and specific regulatory practices with regard to the three China-US-European EMA administrative practices for comprehensive review,compare their features,analysis of their respective strengths and weaknesses,to conduct comparative studies.Part 5 is based on the administrative regulations,the necessity of the EMA and Central Europe's comparative analysis of the administrative practices,for my complete regulations on the behavior of the EMA several recommendations,including the establishment of administrative regulations on the legal basis,the establishment of the EMA database,increase the intensity of the EMA,the establishment of a food security back mechanism,strengthen self-regulation of the food industry.
