The Transformation Of Procuratorial Function Under The Back Ground Of Deepening The Reform Of Judicial System

Socialism with Chinese characteristics has entered a new era,and people’s procuratorial work has also entered a new era.With the improvement of the people’s legal quality and the increase of legal consciousness,the contradiction between the growing demand of the people for the rule of law and the inadequate supply of legal supervision in China is becoming more and more serious.Since 2012,a curtain has been opened on the reform of the rule of law.All parts of the country have successively started to promote the reform of the judicial system.Various measures have taken root,and the process of comprehensively promoting the rule of law is accelerating day by day.At present,the reform of the judicial system has achieved initial results.The report of the 19 th National Congress of the Communist Party of China emphasizes that we should deepen the comprehensive reform of the judicial system,comprehensively implement the judicial responsibility system,and strive to make the people feel fair and just in every judicial case.With the reform of judicial system and national supervision system,the operation mode of procuratorial power has changed,and the procuratorial function has been greatly adjusted.In 2018,the promulgation of the new criminal procedure law and the organization law of the procuratorate gave the procuratorial organ new functions.In order to adapt to the reform and the new functions,the procuratorial organ must constantly change its perspective,actively clarify the new position of the procuratorial function,innovate the operation mechanism of the procuratorial power,create a new environment for the operation of the procuratorial power,make the procuratorial function better focus on legal supervision,and promote the success of the reform of the national judicial system.In 2019,procuratorial organs all over the country began a new round of reform of internal procuratorial organs.This reform will realize the parallel prosecution of criminal,civil,administrative and public interest litigation,integrate the original public prosecution and investigation and supervision departments into one,and implement the mode of "arrest,prosecution and supervision".On April 18,2019,Zhang Jun,the procurator general of the Supreme Procuratorate,made a special guidance report at the seminar for political and legal leaders,saying that we should implement the four major procurators of "criminal,civil,administrative and public interest litigation",fully perform our duties in the coordination and restriction of political and legal departments,deepen the reform of judicial system at a higher starting point,and promote the comprehensive,coordinated and full development of procuratorial functions.Therefore,under the background of deepening the reform ofjudicial system,this paper will analyze the new content and characteristics of procuratorial function,and put forward specific measures to improve the procuratorial function in the new era.In order to implement the general plan of the 19 th National Congress of the Communist Party of China for judicial reform,solve the outstanding problems in the current procuratorial work,and meet the higher judicial needs of the people,procuratorial organs must emancipate their minds,renew their ideas,and consciously adapt to the new requirements of the new era.At a higher starting point,we should plan and plan reform,and constantly improve the procuratorial function to meet the people’s higher demand for the rule of law.
