At the Fourth Plenary Session of the 18th CPC Central Committee,the general goal and major tasks of comprehensively promoting the rule of law were put forward.In January 2018,the CPC Central Committee and the State Council pointed out that the special struggle against underworld crime and evil was an important decision started in the context of comprehensively promoting the rule of law.Therefore,it is a vivid practice in the field of criminal justice to study the"time,degree and result" problem of eliminating underworld crime and evil in the context of comprehensive rule of law.The time limit set for the special campaign against the crime is "three years" ,which does not mean that we will not eliminate the crime after the expiration of the "three years" period,but that we will enter a normal "anti crime" stage after the "three years" period.In the context of comprehensive rule of law,how can we eradicate the underworld crime and evil in accordance with the law? It mainly studies the requirements of "time,degree and result" stipulated by laws and policies.In this paper,the research on "time,degree and result" in the context of comprehensive rule of law is carried out from the following parts:The first part mainly involves the background,research status at home and abroad,research purpose and significance,research methods of "time,degree and result" in the context of comprehensive rule of law.The second part studies the definition and theoretical basis of "time,degree and result" in the process of anti crime,which mainly studies the meaning of"time,degree and result" and the theory.The third part,mainly for the "time,degree and result" research of the cases that bridge cival and criminal law in the special fight against crime.The fourth part is mainly about the research on the"time,degree and result" of the case that bridge administrative and criminal law in the special struggle against the crime.The fifth part is mainly about the existing problems of "time,degree and result" of criminal justice in the special struggle against the crime. |
