The Study On The Legal System Of British Crew Law

The maritime industry is known as "the world's first truly global industry."Crew is a global industry with special dangers and professional skills.Therefore,most countries choose to formulate a special Labor Law for the seafarers in addition to general Labor Law which is called the "Crew Law".Due to the important role of seafarers in the maritime industry,international organizations and countries around the world have attached great importance to seafarer legislation.The ILO adopted the Maritime Labour Convention 2006,which means to protect the rights of seafarers with legislation.Britain is a traditional maritime country with a very long history and tradition in marine.At the same time,there is a very systematic and in-depth study on the protection of crew's rights and interests.The Crew Law has been relatively completed after a long-term development.Therefore,the analysis and research on System of British Crew Laws can provide reference for the establishment of the protection mechanism for seafarers in China.The first Chapter of the article is an overview of the British Crew Law.The main content is the important definitions and legal sources.It will introduce the British Crew Law as a whole and lay the foundation for the analysis and summary of the specific System in the following Chapters.The second Chapter focuses on the British Seafarer Collective Agreement and Seafarer Employment Agreement System,mainly including the formation,content and effect of British Seafarer Collective Agreement,and including the development,conclusion,content and termination of Seafarer Employment Agreement as well.The Collective Agreement System is very important in the British Crew law.In fact,it is also an important mechanism in dealing with Labor Relations in Britain.Trade unions play a very important role in the Seafarer Collective Agreement System.The third Chapter mainly introduces the system of working and life rights of British crew.The British Crew Law sets very detailed and strict standards for the working and living environment of the crew on board.The formulation and implementation of these standards ensure that the crew can be in a satisfied working and living environment.The Crew Union has also contributed to improving the quality of working and living condition of the crew by expressing the demands of the seafarer which are above legal provisions.What the Union does makes promoting the continuous improvement of the legal System of the British Crew Law.Chapter 4 mainly introduces the supervision and guarantee system of the British Crew Law.The main content is to introduce how British ensures the implementation of the Crew Law through the supervision subjects.At the same time,it introduces the supervision mechanism in the British Crew Law,as well as the responsibility the subjects have to undertake.The fifth chapter is the analysis of the characteristics and reference of the legal system of British Crew Law.Through the study of the system in the above Chapters,The characteristics of the British Crew Law System are summarized.China and Britain belong to different legal systems.Therefore,this paper in mainly about the reference of specific legal System in the British Crew Law,and analyze the reasons why the British Crew Law legal system is worthy of China's reference.Aiming at the shortcomings in the legal system of Chinese Crew Law,it can provide a reference for the construction and improvement of the Chinese Crew legal system.
