As the globalization of the world economy deepens,an interconnected world economic system has begun to take shape,and countries' development is interconnected.As the saying goes,small wisdom governs matters while big wisdom governs institutions.In the face of the evolving global economic situation,global economic governance should also keep pace with the times.At present,China's reform has entered a deep-water zone and a crucial period,and the building of a moderately prosperous society in all respects has entered a decisive stage.Therefore,under the promotion of the historical trend and the efforts of the chinese government,China's foreign investment law has made a cross-era innovation.on the new year's day of 2020,China's foreign investment law,regulations on the implementation of the foreign investment law and the interpretation of the supreme court on several issues of the foreign investment law officially took effect.At the same time,China has signed bilateral investment agreements or free trade agreements with some countries in recent years,among which the provisions on foreign investment are also full of shining points.These norms not only meet China's economic development stage and basic national conditions,but also respond to the needs of the development of international common rules,which is conducive to China's continued efforts to create a good business environment,deepen the open economic system.This article mainly aims at the tax provisions of the foreign investment,this paper first introduces a basic theory,and from the two dimensions of cognizance and compensation,through the reference and draw lessons from the advanced international legislation and practice case,analyzes the deficiencies on the current specification,and puts forward solutions,to fill the defects existing in the current legal norms,for a more detailed operational guidelines offer advice.
