In recent years,under the influence of important external factors that have spread the drug problem worldwide and intensified penetration into China,China has witnessed a high incidence of drug crimes and intensified abuses in recent years,and the total number of domestic drug addicts has continued to increase.In the face of the complexity and diversity of cases in judicial practice,different interpretations of the provisions have led to different situations in different regions to deal with similar situations.Therefore,we should comprehensively sort out the crime of accommodating others.First of all,this article describes in detail the regulatory process of tolerating the drug crime of others.Due to the painful historical lessons left by modern China,the Chinese government has always attached great importance to drug crimes,but before the 1990 s,the focus of drug crime crackdowns was on typical supply behaviors and neglect of tolerance The social hazards of other people’s drug use behaviors have led to specific criminal laws.Secondly,because drug use not only harms one’s own life and health,but also causes harm to families and members of society,and even causes a series of secondary crimes,which is not conducive to social stability,and allowing others to use drugs actually provides living space for drug users Therefore,it is also necessary to carry out criminal regulations,and it is necessary to make a separate study on the crime of accommodating others.This article mainly discusses the four elements of the crime,namely the object,objective aspect,subject,and subjective aspect.The author believes that these issues of judicial identification are easy to identify and do not need to discuss in detail,but they will be briefly analyzed when discussing the constituent elements.Finally,the author chooses three research methods: historical research,case analysis,and legal article analysis to carry out a deep analysis of the crime of accommodating others,mainly combing the constituent elements of the crime of accommodating others,and focuses on the discussion of each element in judicial practice.When encountering or possibly encountering difficult problems,summing up various theoretical viewpoints,and expounding the author’s own viewpoints,and combining with the development and change of China’s legislation on the criminalization of the crime of tolerating other people’s drug use,a typical case(opening a network room drug use case)was selected.It examines the new situation and problems of the crime of accommodating others in judicial practice,reveals the new transition between accommodating others and the illegal use of the information network,and analyzes the pros and cons of the current judicial interpretations in conviction standards.
