Studies On Civil Legal Protection Of Network Virtual Property

With the continuous improvement of China’s network construction,the number of Internet users in our country has reached more than half of the total population of our country.Most of the internet users will get virtual property in the virtual space,and this is the new property rights and interests.Presently,China is lack of special legal rules to deal with such case,so in practical life,the disputes of virtual property are often difficult to be properly solved,which has a great impact on the long-term goal of building a harmonious society in China.This paper is composed of four parts.The relevant explanations are as follows.In the first part,the concept of virtual property on the network is elaborated,and combined with the existing information and examples,the various salient characteristics of virtual property are summarized and summarized.Through the analysis and summary of the existing views,the point of view of this article is finally determined.In the second part,the present situation and problems about the protection of virtual property of network in the civil law system of China are discussed.Rules concerning the the protection of virtual property are gathered from the General Principles of Civil Law,Contract Law,Property Law and General Rules of Civil Law.Defects in China’s civil law concerning the difficulty in identifying the subject-protection of network virtual property,the difficulty in estimating the value of virtual property,unclear jurisdiction of virtual property disputes,and the inadequacy of the existing solution mechanism of virtual property disputes would be summed upIn the third part,the contents of the protection of network virtual property in the legal system of foreign countries are studied.Judging from the protection of network virtual property and the setting of legal system in the United States,Korea and Japan,China’s national condition calls for the amendment of the existing law.And then we can further specify the protection measures and the supporting rules by using the judicial interpretation.As a result,the civil legal protection of our network virtual property would be improved.The fourth part,while giving suggestions concerning the full implementation of real name registration,the establishment of the network virtual property evaluation standard framework,the establishment of virtual property management scope,and the establishment of virtual property dispute arbitration mechanism,mainly deals with the improvement of China’s legal protection in regulating and adjusting virtual property.
