Research On The Protection Of Rights And Interests Of Standardized Training Residents

The standardized training of resident physicians is an important part of lifelong medical education and plays an important role in connecting the past and the future.Due to the late start of the standardized training system in China,which is still in the exploration stage,there are some problems in the regulation training system,such as imperfect laws and infringement of rights and interests.Since the launch of the system,contradictions are emerging and disputes are accumulating,which has seriously affected the popularity of the system.As the main participant,the legal status of the doctor is not clear and his rights and interests cannot be guaranteed.Based on the comprehensive theory of laborer and student,this paper describes the infringement of rights and interests of prescription-training physicians and its causes.Combing the experience of foreign countries and the national conditions of China,this paper discusses the protection of rights and interests of residents in standardized training,and puts forward relevant suggestions.This paper is divided into five parts:The first part briefly describes the origin and development of the standardized training system in China,defines the standardized training of residents,and focuses on the difficulties and problems encountered since the implementation of the standardized training system,mainly the serious infringement of rights and interests of the residents.The second part emphatically analyses the rules from the residents legal status,on the basis of the existing theory of students and laborers,and put forward the "the standardized training of resident is a student with the attribute of laborer" comprehensive theory,provides the jurisprudence basis for the subsequent discussion,and theory as the guide discusses the rules from the residents should enjoy the rights and interests of students and staff.The third part describes the infringement of rights and interests of the delegate units,the training base and other outsiders on the resident,combining the classic judicial cases.And through the performance to explore its causes,mainly including the vague legal status,the uncertainty of rights and responsibilities,weak status,lack of relief channels.The fourth part investigates the rights and interests protection system of foreign system and summarizes the enlightenment to China,that is,legislation confirms the dual attribute and further protects its rights and interests.In the fifth part,according to the current situation and the actual situation of our country,the author puts forward some countermeasures and suggestions to further clarify the legal status of residents,improve the reward and punishment mechanism,provide relief channels,reconstruct the association system,add insurance system and improve legal literacy.
