| In recent years,with the emergence of a series of criminal cases,such as the Ting Xu case,the Yujiao Deng case,and the Huan Yu case,there is a constant conflict between network public opinion and criminal trial.The great influence of network public opinion on criminal trial has made the tense relationship between them.After analyzing many cases that have caused widespread concern in the society,we can find that the influence of network public opinion on criminal trial is like a double-edged sword,which will have a positive influence on criminal trial,such as Ting Xu and Huan Yu case,at the same time,have a negative influence on criminal trial,such as the Yujiao Deng case.However,by analyzing the proportion of various influences,the influence of network public opinion on criminal trial is mostly positive.In China,the reasons why we do not deal with the relationship of network public opinion and criminal trial perfectly are mainly related to imperfect legal system,low judicial credibility,low judicial transparency and so on.Because Western countries have more democracy and freedom,they are more rational in dealing with the relationship between network public opinion and criminal trial compared with China.They insist on the balance of judicial independence and discretion in the whole process of criminal trial.It will have great practical significance for dealing with the relationship between network public opinion and criminal trial by learning Western theoretical and legislative experience.It is still a long-term and arduous task to how to strengthen the positive interaction between network public opinion and criminal trial in China.In consideration of China’s national conditions,we can still promote the positive interaction between network public opinion and criminal trial by regulating the relationship between the media and the judiciary,improving the judiciary credibility,formulating relevant laws and regulations and so on. |
