Research On Legal Issues Of Private Equity Investment Fund

As we all know,private equity investment funds have developed and matured in the United States.After several years of improvement and progress,they have become an important new financing means in the economic society.In today’s society,with the continuous progress of globalization,China’s market economy is in line with global finance.After more than 30 years of development,private equity investment funds are still too young compared with developed countries.However,as one of the most important financing means in the current global economy,private equity investment funds have been attached importance to and supported by our government in all aspects,and relevant laws and regulations have been adopted.With the continuous introduction,the private equity investment fund industry has developed vigorously and healthily.Of course,the road of rapid development is bound to be accompanied by various difficulties and obstacles.Starting from the basic concepts and characteristics of private equity investment funds and combining with the investigation of the development process of private equity investment funds in China,this paper systematically expounds the three main organizational forms of private equity investment funds,namely company-based funds,partnership-based funds and contract-based funds,and analyses the operation mode of private equity investment funds.The current Company Law of the People’s Republic of China,Partnership Enterprise Law of the People’s Republic of China,Securities Investment Fund Law and other relevant laws and regulations,analyze the current status of the norms of private equity investment funds in China,summarize and summarize the legal problems existing in China’s private equity fund system,combined with the United States,Britain,Japan and other developed countries on private equity.The legislative review of investment funds,and then from the aspects of private equity fund raising system,information disclosure system,exit mechanism and legal supervision,put forward some suggestions to improve the system of private equity investment funds in China,in order to provide reference and reference for promoting the healthy and stable development of private equity funds in China.
