Research On Copyright Protection Of Short Dance Video

The emergence of short video platform accelerates the transformation of the existing form of dance.On the one hand,short video platform provides a new communication path for traditional dance works,and creates a new era of dance innovation and communication.On the other hand,the short video content of its own is short and refined,which also promotes new dances such as gesture dancing with small range,low difficulty,unlimited occasions and interesting occasions.Form comes into being.However,while the Internet brings convenience to dissemination,it also brings many problems to the protection of dance short video copyright.Through empirical investigation,this paper will dig out the problems of copyright protection in short dance videos,and put forward a relatively perfect copyright protection mechanism for short dance videos based on theoretical and practical analysis.The content of the paper mainly includes the introduction and five parts:The introduction first introduces the research background of the topic,the research status and existing problems before the topic,that is,the discussion of the copyright of dance works lags behind,the research in dance field and short video field is relatively separated,which is not conducive to the copyright protection of short dance video,and puts forward the idea that it is necessary to improve the protection mechanism.The first part of "Dance Short Video Overview" mainly introduces the concept and characteristics of Dance Short Video.Dance Short Video is the product of the combination of Dance and Short Video,but it is not a simple addition.This part explains the connotation and extension of Dance Short Video,which is the starting point of this paper.The second part,"Analysis of Copyright of Dance Short Video" takes the first case of short video work identification,one of the top ten copyright cases published at the end of 2018,as the breakthrough point.Based on this case's short video identification standard,it clarifies the original requirements of dance short video,liststhe types of dance short video,and analyses the works one by one.Finally,the scope of this paper is limited,that is,the short dance video that constitutes the work.The third part "The current situation of the copyright protection of short dance video" studies the current situation of the protection of short dance video from three aspects: current legislation,communication platform and users.It mainly collates the legislation of short dance video in China,compares and analyses the protection measures of the copyright of the major short dance video platforms,and distributes questionnaires for dancers and dance enthusiasts.Analyse,find out the actual problems,and establish the interest mentality of the stakeholders in all aspects of infringement.The fourth part "The dilemma of the protection of the copyright of short dance video" mainly analyses the difficulties in the protection of the copyright of short dance video from different angles,including whether infringement is difficult to define and the rights of participants in short dance video works are difficult to guarantee;the protection links such as permission and payment eliminate the dissemination power,so that the obligee is idle in the protection of rights and easy to form a vicious atmosphere;and the relevant rights protection system is not unified,and protection measures are scattered,etc.The fifth part is "the perfect countermeasure of the copyright protection of short dance video",which mainly aims at the predicament of the preceding part,and puts forward the perfect countermeasure,that is,to balance the interests of all parties through the whole process with the principle of balance of interests;to improve the standard of tort identification of short dance video;to strengthen the self-protection of the right holders;to establish a digital dance collective management organization;and to encourage the research and development of short video platform technology.
