| In recent years,the scale of the compensable storage industry of stem cells has been increasing exponentially,but the construction of the regulatory system for this industry has not been synchronized with the speed of industrial development,resulting in the disorder in this field,which seriously damaged the rights and interests of the depositors.At present,the main reason for the damage of the rights and interests of the depositors is the lack of the regulatory standards in the legislative level.The second is that the existing legal context makes the paid storage depositors of stem cells unable to be defined as the consumer groups,which leads to the disadvantage of the legal application and the difficulty of judicial relief.Therefore,this article hopes to strengthen the industry governance of compensatory storage of stem cells and bring the rights and interests of depositors into the protection system of consumer rights and interests through legislative adjustment,so as to reduce the production of storage disputes in advance,and to smooth the relief path and stop the loss as soon as possible after the damage.Through combing the existing problems of the protection of the rights and interests of the paid storage storage of the stem cells,this paper analyzes the legislative insufficiency resulting from the institutional management,the personnel management,the construction of the regulatory system,the clear rights of the depositors and the plight of the law,and then combines the particularity of the paid storage business of stem cells in turn.On the basis of clarifying the legal attributes of the stem cell storage institutions and the legal relationship between the two sides,the author proposes to optimize the access of the institutions,improve the training system and organization of the employees,adjust the distribution of the authority of the regulatory authorities,clarify the content of the rights of the depositors,and adjust the law of the protection of the rights and interests of consumers.In order to solve the above problems,we should strengthen the legislative protection of the rights and interests of paid storage depositors. |
