Research On The Protection Of Consumer Safety Rights

In recent years,with the diversified development of consumption mode and the leap of network technology,consumer security is facing more and more tests,consumer security right is also facing great challenges.The so-called consumer safety right is the right of consumers to enjoy,obtain quality assurance,absolute safety and reliable health products or services in order to ensure their physical and mental health and safety in the process of consuming the products or services when they purchase the products or services provided by producers and operators.Consumer safety right is the most fundamental and important right in consumer rights and interests,and the premise and guarantee of exercising other rights.The importance of harmony,stability and security is self-evident in an era of openness,volatility and uncertainty.Consumer safety right,as a right of the vulnerable,is the protection of consumer’s personal and property information.With the risk of social economy,consumer safety right faces more and more problems.The weakness of consumers’ rights and interests makes all countries strengthen their rights and interests protection,but the problem of consumption safety still cannot be effectively solved.The new law on the protection of the rights and interests of consumers was put into operation in 2014,solving some problems.Consumer information security was included in the law for the first time.This article mainly USES the methods of comparative research and empirical study,analysis of reading a large number of consumers at home and abroad security related books and information,understanding of consumers’ rights and interests protection situation in our country,analyzing the rights of the consumer safety damage,absorb advanced foreign experience and combining with the situation of our country is put forward on the basis of perfect path.The author believes that at present,the infringement of consumer safety rights mainly focuses on food,drugs,cosmetics,accommodation and catering industry and other important areas.In recent years,the "elevator cannibalism incident","tourist groups beat tourists phenomenon","mobile phone screen explosion disfigured people" and other appalling news show that China’s consumer safety issues need to be addressed.This paper finds the data of consumer cases and consumer associations in recent years,and through the analysis of basic concepts and characteristics,thinks that the main reasons for the lack of consumer safety are the following: Weak enforcement by law enforcement departments;Consumer associations are not playing their full part;Illegal ACTS of business operators;Weak consumer legal awareness;Lack of corporate social responsibility.On this issue,we can learn from the advanced experience of foreign countries such as the United States,Japan,Germany and Britain,and combine our national conditions to protect consumers’ consumption safety.The author thinks that the protection of consumer safety right can be realized gradually by perfecting laws,establishing new mechanism and strengthening functions of consumer association.Governments at all levels shall establish emergency response mechanism and effective prevention mechanism,strengthen the legislation of advancing with The Times,strengthen the administrative protection and security to consumer rights disputes judicial judgment,continuously expand the ways for consumer rights protection and solve the problem of consumer groups of litigation and public interest litigation,increasing consumers’ rights and obligation of the operator with the combination of alignment,increase the intensity of punishment,improve the illegal cost,from a security source to reduce the probability of danger happening,let consumer personal,property,information,and consumption so as to protect the security,at the time of consumption without worries.The right to consumer safety can certainly be maintained through the efforts of all parties in the society.Only by effectively protecting the right to consumer safety can it be conducive to economic development and social stability and harmony.
