Research On The Legal System Of Financial Lease Supervision In China

Financing lease originated in the United States in the middle of the 20 th century,in the modern society highly monetized and Credit market economy condition,it as a combination of margin trading pattern emerging,rapidly worldwide attention,many countries are competing for the development of financing leasing,development until now,its gradually set up for a second only to the bank credit way to trade.This paper comprehensively discusses the existing basic theories of the legal system of financial leasing supervision,and use the comparative research method and the comprehensive research method to compare the regulatory models of foreign countries,and draws on some mature experience to analyze the imperfections of the legal system of financial leasing supervision in China.This paper discusses from five aspects,namely,the construction of government-guided supervision,the strengthening of on-going and post-event supervision,the formulation of special laws for the industry,the improvement of relevant supporting systems of financial leasing and the improvement of internal supervision and management,in the hope of putting forward some practical and effective Suggestions to further improve the legal system of financial leasing supervision in China.The first part mainly expounds the theoretical basis of financial leasing supervision,including the definition,function,nature and theoretical basis of financial leasing supervision,etc.Only by clarifying these basic theories of financial leasing,can further analysis be conducted on this basis.The second part mainly describes the current stage of China’s financial leasing supervision legal system,as well as some problems.For the development status of financial leasing supervision legal system,this paper studies the important legal documents issued since financial leasing entered China.The problems existing in the legal system of financial leasing supervision are mainly explained from five aspects: the research on the supervision mode,the supervision after the event is neglected,the inconsistent legal documents of financial leasing supervision,the imperfect supporting legal system of financial leasing supervision and the lack of supervision and management within the industry.Only through in-depth analysis of the current situation of China’s financial leasing supervision and legal system as well as the current problems,can we truly and accurately find the research direction for the fourth part.The third part mainly expounds the relevant legislation and system problems of some foreign countries on the supervision of financial leasing,respectively enumerates the specific supervision systems of the United States,Japan,Germany and South Korea,and makes a brief analysis of the systems of various countries,fully drawing on the experience of other countries.The fourth part further provides theoretical basisFourth part as a key section of this article,mainly put forward the our country finance lease regulation legal system of some improving opinions,this part is mainly from the establishment of appropriate regulatory mode and strengthen the supervision of things afterwards,formulate industry Special law,perfecting the financing lease related supporting system and perfect the internal supervision and management of the five levels,and for the construction of our country financing lease law system of regulation direction is given.
