Research On The Ptotection Of Privacy In Technical Investigation

With the increasing technology and concealment of criminal behavior,the traditional investigation has been unable to meet the needs of investigating cases,and technical investigation emerged as the times require.However,due to the technical and secret characteristics of technical investigation,it is bound to be a violation of citizen's right to privacy.The Criminal procedure Law of 2012 lays a theoretical foundation for the application of technical investigation,but the provisions of the law are too principled.For some cases,it is too broad and vague,which undoubtedly creates a space for investigating organs to infringe on citizen's right to privacy.This paper analyzes the problems in the protection of the right of privacy in the technical investigation,discusses and uses for reference the technical investigation measures of the applicable standards,the examination and approval procedure,aiming at the problems existing in the technical investigation in China,absorbed and learned from the beneficial experience of foreign countries,give some suggestions to the problems existing in the technical investigation of our country,and hope that the technical investigation can be standardized and ruled by law.
