Reputation infringement in information dissemination has always been a common concern of Journalism and law circles.The direct protection of the right of reputation of citizens and legal persons in our law first appeared in 1986 when the General Principles of the Civil Law of the People's Republic of China were implemented.Over the past thirty years,with the continuous development of news practice and judicial practice,the law of our country has formed mature,stable and operational regulations including legal norms at different levels for the infringement of reputation that often occurs in news communication.Standard system;the press has also formed mature experience in avoiding disputes over reputation rights.However,the innovation of media technology has changed the overall situation of the whole society.Internet and mobile network have entered the lives of ordinary people,and gradually play an increasingly important role.Dialectically,every progress of technology will promote the progress of human civilization;however,at the beginning of the birth of new technology,the lag of system and humanistic literacy often leads to the abuse of new technology,resulting in frequent infringement in the short term.In today's society,endless network piracy,network pornography,network rumors,network infringement and so on make the network space muddy,good and bad,to a certain extent,offset the dividends released by technological progress.Network reputation infringement is one of the representative types.Compared with the traditional media,network reputation infringement has its own distinct characteristics and manifestations: more diverse means of infringement,more serious consequences of infringement,and difficult to prosecute for infringement liability.At the same time,network reputation infringement occurs frequently,which greatly pollutes the network communication environment,and how to reduce and contain this network.Network pollution has also become a key topic in the field of communication law,and it is also the center of this study.This research is based on the topic of "reputation infringement and legal regulation in network communication",and adopts the disciplinary perspective of combining journalism and communication with law.In the body part,the author first makes a historic analysis of the disputes over the right of reputation in the traditional media era.Explain the constitutive elements and legal liability of reputation infringement;then focus on the issue of media lawsuits caused by public opinion supervision and how to coordinate the relationship betweenthe media and the judiciary;finally,elaborate on the core issues of reputation protection – the confilict between freedom of expression and individual name;Chapter three is an empirical study of the network reputation infringement under the new media technology conditions.In this chapter,the author through the interpretation of specific cases shows that network reputation infringement in the subject of infringement,the object of infringement,the form of infringement and the consequences of infringement.Chapter IV is based on the legal norms on which the network reputation infringement cases are tried at the present stage in our country.At the same time,based on the judicial practice,the court often encounter three major legal problems in the trial of such cases.The fifth chapter is the conclusion.Through the above analysis,the author puts forward his own suggestions on how to reduce network reputation infringement and purify the network communication environment.
