Study On Investigation And Evidence Collection Of Traffic Accident Criminal Cases

In recent years,with the increasing of motor vehicles,contradictions between people,vehicles and roads are prominent and traffic accident happen frequently.In practice,traffic accident crime has become one of the multiple crimes.But because of particularity of traffic accident criminal cases,the author found such questions,for example,indifference of investigating and collecting evidence of grassroots police,inadequate capacity of individual,unscientific and non-standard methods and so on,all of these induced to different quality of handling this type of cases.The paper combining specific cases and analyzing of practical problems in investigation practice from the perspective of practice,discussed the relevant problems in the process of investigating and collecting evidence in traffic accident crime cases with a view to providing useful reference for improving the quality of handling cases.The paper was divided into three parts: introduction,body and conclusion.The introduction contained the background of investigating and collecting evidence in traffic accident criminal cases,and put forward necessity and purpose of research in the paper.The body was discussed in four chapters.The first chapter outlined the traffic accident crime and investigation of traffic accident crime,defined the crime of traffic accident,briefly introduced the subject of investigation of traffic accident crime and common investigative measures,and defined the scope of research.The second chapter introduced the characteristics of traffic accident crime investigation and evidence collection,analyzing respectively from the traffic accident crime case itself,evidence,the characteristics of criminal suspects,and provided support for the following improvement proposals;The third chapter,mainly taking G county of SD province as the research object and coupling the specific cases,it analyzed the investigative subject,investigative methods,investigative consciousness and so on about investigating and collecting evidence of traffic accident criminal case.And then the author analyzed the existing problems from insufficient police force,weak awareness of evidence,single method of obtaining evidence and other aspects.The fourth chapter put forward suggestions to improve the work of investigating and collecting evidence in traffic accident crime cases.The conclusion was the summary of the whole paper,and the prospect of how to improve the work of investigating and collecting evidence in traffic accident crime cases in the future.
