The wave of reform and opening up for forty years has accelerated the process of urbanization in China,the urban area has expanded,and the prices of urban commercial housing have soared.Many low and middle-income groups with demand for housing can't afford it,but small property houses with moderate prices have been shipped.The number of small property houses has soared.It has not only become a hot topic of discussion in society,but also has become the focus of many scholars.Scholars have no common idea about the various legal issues of small property houses.Since the Third Plenary Session of the 18 th CPC Central Committee,the pace of reform has accelerated,and the reform of urban and rural construction land has been integrated into the crucial stage.In August 2017,the Ministry of Land and Resources and the Ministry of Housing and Urban-Rural Development jointly issued a document to conduct pilot projects for the construction of leased housing using collective construction land in 13 cities.From 2007 to 2019,in Peking,Shanghai and Huai'an City,Jiangsu Province,The construction of shared property houses was carried out to promote collective construction land and state-owned construction land with the same rights.However,the above pilots mainly focused on housing construction on collective construction land,and did not propose a clear solution for small property houses.The handling of small property houses has received much attention and has become an urgent problem to be solved.Starting from the dual dimensions of law and society,this paper discusses the legal issues of small property houses in four parts.The first part explains the basic concept of small property houses,aiming to have a more detailed understanding of small property houses.The content mainly includes the concept and characteristics of small property houses,classification,and its advantages and disadvantages;the second part analyzes the current situation of small property houses,and summarizes the social status,legislative status and judicial status of small property houses;the third part discusses the reasons for the formation of small property houses.Specifically,it includes the economic reason,legal system and the law enforcement supervision reason;the fourth part proposes relevant suggestions for solving the problem of small property houses,including legislation,law enforcement,justice and realistic measures,aims to fundamentally eliminate the small property houses.
