A Study On Judicial Assistance Of Traffic Accident Cases In Dongguan City

Dongguan City is located in the middle and south of Guangdong Province,on the eastern coast of Zhujiang River Estuary,and in the middle section of the Guangzhou-Shenzhen-Hong Kong Economic Corridor.It has always been an important gateway to the South of China,and it has the reputation of “the head of the four tigers” in Guangdong Province.As a city with rapid economic development,Dongguan has developed highway transportation,and its highway density ranks in the forefront of Guangdong Province.With the improvement of economic development and living conditions,there are a growing number of car owners in Dongguan.However,the traffic facilities in Dongguan City failed to improve in time with the increase of vehicles,and their traffic accidents ranked in the forefront of Guangdong Province.After a motor vehicle traffic accident,the case cannot be detected,the defendant has no ability to compensate,or the compensation capacity is insufficient.The victim and his close relatives are not effectively compensated according to law,and life is in trouble.This situation not only has a lot of adverse effects on the image of the judiciary in society,but also expands or triggers fierce contradictions,which hinders the harmonious development of society.The implementation of traffic accident compensation is a difficult point in judicial practice.As a bailout outside the tort liability mechanism,judicial assistance provides a green channel for economic support for victims of traffic accidents.This has become the focus of attention for victims of accidents.From a humanitarian perspective,judicial assistance provides help to victims,enabling them to receive timely assistance,maintain a normal life,and reduce the financial burden of the perpetrators.From a social perspective,judicial assistance also resolves security risks that threaten society.Therefore,the judicial assistance system for traffic accidents needs to be improved urgently to provide effective support to vulnerable groups.In this paper,based on the literature research method and case analysis method,the ineffective implementation of judicial assistance,cumbersome procedures,imperfect supervision system,lack of scope and standards,and difficulties in implementation of traffic accident cases in Dongguan are analyzed.On the basis of judicial assistance and combined with laws and regulations,corresponding countermeasures are proposed.For example,the implementation is strengthened,the judicial assistance procedures are improved,the supervision system is perfected,the scope and standards of judicial assistance are improved,and the implementation difficulty is reduced.It hopes that this study can provide support for the judicial rescue of traffic accident cases in Dongguan,and provide useful reference for the theoretical research of judicial assistance.This will help to improve the judicial assistance procedures and systems for traffic accidents in China,promote the implementation of the judicial assistance system,and give more help to those in need of judicial assistance to safeguard the interests of vulnerable groups.At the same time,the contradictions of the public are resolved and social develops harmoniously.
