A Study On The Administrative Law Enforcement System Of Anti-unfair Competition Law

Following the globalization and the integration of the world economy,China has joined the international competition.It also means more opportunities to our country's economic development and more challenges to the law enforcement agencies to maintain fair competition in our competitive market.China specially enacts "Anti-Unfair Competition Law of the People's Republic of China" that regulates the unfair competition.And it plays a key role in regulating the market economy and maintaining orderly competition.However,the era of continuous progress,the content of the market economy is also constantly enrich,which makes the current law more and more can't keep up with the pace of the times,especially in the administrative law enforcement of anti-unfair competition law.The administrative law enforcement of anti-unfair competition law regulates the behavior of unfair competition,it is vital to the stability of the competitive market order.As a means of national intervention for the competitive market,the anti-unfair law ensures that the competitive market is fair.However,there are some problems such as unified law enforcement agencies in the field of anti-unfair competition law and defects in the rights of subjects.These problems have reflected that the administrative law enforcement system of China's anti-unfair competition law needs to be improved.Hence,it is necessary to study the administrative law enforcement system of anti-unfair competition law and explore an administrative law enforcement system suitable for our anti-unfair competition law.This paper mainly uses the method of literature and comparative analysis.The first part of this article mainly elaborates the meaning of the administrative law enforcement system of China's anti-unfair competition law,clarifies the relevant concepts,analyzes the relationship between competition and unfair competition,administrative law enforcement and political law enforcement system.The second part introduces the current situation of the administrative law enforcement system of China's anti-unfair competition law,describes the existing problems and points out the main reasons of the problem.The third part talks the foreign administrative law enforcement system and its advantages over our country's.It mainly focuses areas like the United States,Germany,Japan and Taiwan in China.Combining with China's actual situation,it gives some advice about what we can learn from foreign competition law enforcement law enforcement advanced experience.The fourth part puts forward the suggestions to further enhance the administrative law enforcement system of our country such as building a unified anti-unfair competition law administrative law enforcement subject,improve the anti-unfair competition law enforcement right and procedures,and giving more training to the anti-unfair competition law enforcement officers.
