An Legal Analysis Of The Employer's Termination Clause In International EPC Contract

EPC is the abbreviation of the first letter of the “engineering,procurement and construction”.The EPC model is one of the commonly used contracting models in International Engineering.Although the objectives of both parties to the EPC contract are the completion of the project,the benefits pursued by the parties and the way they achieve their objectives are not exactly the same and even conflicting which is the source of the contract dispute.In view of the characteristics of international projects,if the employer terminates the contract,it will place the contractor into a very awkward position.Therefore,this paper focuses on the analysis of the terms of “the employer's termination” in the EPC contract and hope to identify the risk and find out the dispute resolution techniques that the contractor may encounter.
