Study On The Legal Problems Of Environmental Protection Of Rural Tourism In Guizhou Under The Background Of Rural Revitalization

With the blowout development of rural tourism in the whole country,Guizhou Province,taking advantage of its excellent natural geography,colorful culture and abundant environmental resources,has now formed a rural tourism development model with national characteristics as its main brand,and has become a new grasp of rural revitalization,poverty alleviation and prosperity.Although the development of rural tourism in Guizhou has made gratifying achievements,rural tourism in Guizhou started relatively late,and there are extensive ways of development in the process of development.The problems of ecological environment in rural tourism areas have become increasingly prominent,along with environmental protection problems such as solid waste pollution,water pollution,air pollution,soil destruction,noise pollution and so on.Therefore,the environmental protection in the development of rural tourism in Guizhou needs urgent attention.It is of great practical and theoretical significance to explore how to construct the corresponding legal system from the perspective of environmental and resource protection law.This paper studies the legal issues of environmental protection of rural tourism in Guizhou under the background of Rural Revitalization from the following parts.In the introduction part,the research background,research significance,domestic and foreign research summary,research ideas and methods are described comprehensively.Chapter 1 discusses the concept,characteristics,strategy of rural revitalization,Guizhou rural tourism and the five development concepts of "innovation,coordination,green,opening and sharing",especially the "green" development concept,in order to strengthen the basic theory of this study,and then expounds the existence of solidwaste pollution,water pollution,air pollution and soil in Guizhou rural tourism.Environmental problems such as damage and noise pollution.The second chapter is about the legal issues of rural tourism environmental protection in Guizhou.Firstly,the absence of supporting provisions at the legislative level.According to the author's collection of documents and consulting materials,the laws and regulations regulating rural tourism in Guizhou are mainly scattered in the Tourism Law of the People's Republic of China and the Tourism Regulations of Guizhou Province,especially in the Tourism Law,which has few direct provisions on rural tourism.However,the provisions of Guizhou Provincial Tourism Regulations on rural tourism environmental protection are mostly limited to principles and directiveness,and fall into the dilemma of inadequate use of laws or even inadequate dependence.In addition,there are many difficulties in starting environmental public interest litigation procedures,such as waste water and gas disposal,random dumping of garbage,destruction of soil resources and environmental damage caused by rural tourism,and weak awareness of environmental protection at the public level.The third chapter is the legal experience and Enlightenment of rural tourism environmental protection at home and abroad.This chapter sorts out and expounds the experiences and practices of environmental protection in Germany,the United States,Japan and Australia in the process of developing rural tourism,and extracts the cream from the successful development mode of Taiwan,Chengdu,Yunnan and Xinjiang in the typical areas of China for the purpose of Guizhou's rural tourism.Healthy,benign and sustainable development.This paper summarizes the legal inspiration of rural tourism in typical foreign countries and typical areas in China,including improving the legal system of rural tourism environmental protection,building a special organizational system,formulating industry evaluation standards and strictly implementing the system,building a government guidance and support system,and building a more optimized public participation system.The fourth chapter is the core part of this study,that is,the construction of Guizhou rural tourism environmental protection legal system under the background of Rural Revitalization strategy.In order to solve the problems of solid waste pollution,water pollution,air pollution,soil destruction and noise pollution brought about by rural tourism development,we should actively learn from the advanced experience of developed countries and some parts of China in developing rural tourism,and put forward the following ideas of rule of law based on the situation of Guizhou Province.From the legislative level,it is suggested to formulate the Measures for Promoting the Environmental Protection of Rural Tourism in Guizhou Province,so that the environmental protection of rural tourism can be legalized,regulated and healthy.At the law enforcement level,it is suggested to strictly implement the environmental impact assessment system,the environmental tax system,the daily penalty system and the ecological compensation system.At the judicial level,it is suggested to improve the public interest litigation system of rural tourism environmental governance,strengthen the judicial protection of the judicial team and innovate the mechanism of determining the amount of damages.Finally,from the level of public participation,we need to increase publicity through various channels to enhance public awareness of environmental protection in the process of rural tourism.
