Study On The Application Of Work Safety Law For Road Traffic Accident

With the rapid development of economy,the concept of safety in production has been paid more and more attention by the state.As the basic law in the field of safety in production,the promulgation and implementation of the Work Safety Law have an important impact on the production and operation activities.At present,the legal system of safety in production has been basically constructed in China.Through various practices encountered in the process of law enforcement by the Safety in Production Supervision and Administration Bureau.Legislators have also revised and improved the Work Safety Law.Strict implementation of the Work Safety Law has made outstanding contributions to reducing production safety accidents and guaranteeing people's personal and property safety.However,in the process of implementation,the Work Safety Law still reflects its deficiencies in legislation.By analyzing the differences and links between road traffic accidents and production safety accidents,the constituent elements of production safety accident liability in the Work Safety Law can distinguish between production safety accident liability and road traffic accident liability.Through literature research method,empirical research method,comparative research law,regulation,etc.Fan Research Law summarizes the scope of application of Work Safety Law and the misunderstanding of Article 109 of Work Safety Law in "Supreme People's Court's Response to Administrative Punishment and Applicable Legal Questions on Road Traffic Safety" on whether safety supervision departments have the right to apply Work Safety Law and "Regulations on Reporting and Investigating and Handling of Safety Accidents in Production",and puts forward the misunderstanding of Article 109 of Work Safety Law.Suggestions on the amendment of the scope of application of Article 2 of the Full Production Law and on the suspension of the application of the Supreme People's Court's "Supreme People's Court on Whether Safety Supervision Departments have the right to apply the Work Safety Law" and "Regulations on Reporting and Investigating and Handling of Production Safety Accidents" to impose administrative penalties on road traffic safety issues and replies to applicable legal issues,as well as specific suggestions on increasing publicity of the Work Safety Law.
