Research On The Exception Of Police Information Disclosure

The exception to the disclosure of police information is the key to determining the scope of disclosure of police information.Under the guidance of the "Regulations on the Openness of Government Information of the People's Republic of China"(hereinafter referred to as the "Regulations on the Openness of Government Information"),only by continuously improving the publicity of police information and implementing "sunshine policing" can we better protect the legitimate rights and interests of citizens.However,because the "Regulations on the Disclosure of Government Information" is supported by the lack of relevant practices at the beginning of the formulation,it is difficult to consider all government information disclosure exceptions and make targeted regulations.In addition,the public security organs themselves have both administrative functions and criminal justice functions,which leads to many difficulties in the handling of police information disclosure exceptions.At present,there are not many written articles on the issue of police information disclosure exceptions in China.Domestic research focuses on the system of publicity of police information disclosure from a macro perspective,lack of systematic control over the disclosure of police information,and the inability to disclose exceptions for police information.The problem provides a systematic solution.From the practice of the exception of police information disclosure,whether it is a physical exception or a procedural exception,both of them are the reasons for blocking the disclosure of police information.Therefore,it is necessary to study the exceptions of police information disclosure from these two situations,classify and discuss the exceptions of police information disclosure,find the application difficulties,and then propose scientific and effective solutions.Based on the above situation,the paper is divided into four parts.The first part is the definition of the exception of police information disclosure.Starting from the concept of police information,clarify the connotation of police,police information and police information disclosure exceptions,taking the exceptions of public security organs' police information disclosure as the research object,and grasping the characteristics of police information disclosure exceptions;It is an exception to the disclosure of police information.According to the "Regulations on the Disclosure of Government Information",the exceptions to the disclosure of police information are divided into two aspects: substantive exceptions and procedural exceptions.The third part is the status quo of police information disclosure exceptions.On the basis of grasping the status quo of the exception of police information disclosure in China,combined with the actual case,it summarizes the application difficulties of the police information disclosure exception from the aspects of legislation,law enforcement and justice.The fourth part is about the exception of police information disclosure exception.The problem is to put forward suggestions for improvement from the three aspects of legislation,law enforcement and justice.
