Research On Monitoring Changes In Residence

As a criminal measure,surveillance residence was made relatively complete changes and clearer rules in the 2012 Criminal Procedure Law.Compared to before,there has been a great improvement,with the revision of the 2018 Code of Criminal Procedure,it will inevitably further increase the scope of application and space.However,in the specific application of judicial practice,there are still difficulties and confusion.Especially in the use and practice of public security organs,a lot of resistance was encountered and a series of problems were encountered.Whether it is a rigid law itself vulnerable defects,or judicial officer of the legal system to ignore the spirit of misunderstanding,lack of improper use of flexible,it will lead to further lower implementation efficiency.Article starts from practice,through more detailed empirical investigations,to see through the issues and solve problems at the practical level.This paper is mainly composed of the following parts.The first part is statement of problem.This section highlights the serious consequences of monitoring residence and changing abuse in the current law enforcement environment by presenting real-life cases,and objectively reflects the problems associated with monitoring residence and change.The second part is monitoring changes in residence from the perspective of legal norms.This section uses a macroscopic perspective,from the perspective of monitoring residential legislation,practical operation,academic debate and other aspects,expounds all aspects of surveillance and housing,and more intuitively shows the current dilemma of monitoring residential and changing measures.The third part is empirical investigation of surveillance of residential changes.This section uses a macroscopic perspective to explain all aspects of surveillance and living from the perspective of monitoring residential legislation,and more intuitively shows the current difficulties in monitoring residential and change measures.The fourth part is thinking on the rule of law in monitoring residential change.This section focuses on the issues that have arisen in the above-mentioned practice surveys,combining theory with practice,describe the corresponding improvement methods and measures.
