In response to the requirements of the Internet 3.0 era,the Amendment to the Criminal Law(9)set up two new charges for Internet service providers.However,as the judicial practice and academic discussions continue to deepen,it is not difficult to discover the Internet service providers themselves.Is a very broad concept,it is difficult to draw directly from the concept of internet service providers legal behavior border,let alone demarcate the boundaries of criminal liability.Therefore,to study the problem of criminal liability of internet service providers,what kind of criteria is selected to classify internet service providers is the premise and basis for research;on the basis of division,the choice of imputation path depends on the service providers.Whether or not the service behavior is consistent with the conduct of the criminal law,that is,the behavioral analysis of its actions and inactions is an important method of path selection.After that,it mainly analyzes what should be assumed through relevant cases and legal theory.It is the responsibility of committing or accomplice.Therefore,on the basis of the previous scholars' research,this article decided to adopt a typed research method to classify an overall concept.In the first part,the technical function was adopted by drawing lessons from foreign legislative experience and combining with the development trend of the current Internet society.Sexual differentiation is used as a partitioning criterion to divide internet service providers into internet content service providers,storage service providers,cache service providers,and internet access and transmission services in accordance with the relationship between the proximity of the provided content and control possibilities.There are four categories of providers;on the basis of this,the first part defines the implementation behavior of internet service providers in connection with the "Rapid Case" as the basis for the study of the criminal liability of internet service providers,and then discusses the general approach.The imputation is due to the controversy in this part of the academic circle,so only an overview of the different kinds of imputation aimed at different subjects has been made.In the not-to-be-partial part only the non-fulfilment of non-fulfilment of internet content monitoring obligations is to be justified from three aspects of social harm,obligation sources,and equal value theories,and it should be noted that distinguishing inaction here is not equivalent to The inaction in the refusal to fulfill the obligations of cyber security management obligations is due to its existence as a difference between the scope of the obligation and the subject.Therefore,the current legislation has the problem of extending the scope of penalties,which can be defined as a reasonable subject and the delimitation of different parties' burden obligations.The third part examines the issue of accomplices responsible for imputation,first clarifying the limits of imputation of neutral assistance behaviors,adopting the objective theory as the basis of the compromise theory,and secondly defining the theory of accomplices guilty of recidivism.The premise,negating the sentencing standards doctrine,and then restricting the application of each kind of specific service type to its rightful culpability.According to the confusion in the academic and judicial judgments about the above-mentioned attribution of non-performance,contributory acts of conviction and general accomplice imputation,and the confusion of sentencing errors,we propose to distinguish between the two aspects of subjective and objective factors.Combined with relevant cases to solve the puzzles,the boundaries between imputation methods can be divided.
