Analysis Of Legal Issues Of Road Traffic Accident Identification

Since 1980,with the development of social economy,the number of motor vehicles has increased rapidly,traffic accidents have occurred frequently,personal injuries have been heavy,and property losses have been huge.Road traffic accidents have become a social problem.According to the Law of the People's Republic of China on Road Traffic Safety promulgated in 2003 and related regulations,road traffic accidents were identified as evidence to deal with traffic accidents.The departmental regulations of the Ministry of Public Security also canceled the reconsideration procedures for traffic accident liability determination.The court issued a judicial interpretation that no longer accepts administrative proceedings against the traffic accident liability.The question of how the rights of the parties to carry out relief is highlighted.This paper analyzes the legal issues of road traffic accident identification through comparative research method and empirical research method,and clarifies the main elements,behavioral elements and procedural elements of accident identification.The purpose is to give the parties the opportunity to obtain relief.This article explains from five aspects.In the first part,the author analyzes the main purpose of this paper from the direction of the subject of traffic accident identification.In the second part,the author analyzes the behavior identification after traffic accidents.In the third part,this paper The author analyzes the content of the accident confirmation book.In the fourth part,the author investigates the process of the procedure after the accident judgment.In the fifth part,the above analysis layer is further elaborated and explained in the face of the parts that are not involved or need to be supplemented.
