Airbnb,a short-term rental platform in the United States,became one of the most important participants in the sharing economy after ten years since its establishment.It has also been able to share common ground with Uber,Meituan and Dianping,and Mobike bicycles in the field of sharing.Most of these companies have a multilateral platform model that provides a variety of Internet-based platforms and application software,and that creates new ways for people to share goods and services on an unimaginable scale.They act like a virtual counterpart,reducing transaction costs and facilitating configuration.Under the background that most share-economy companies adopt the multilateral platform model,the supervision and regulation of the platform is particularly important.Even though these companies are still in the early stages of development accompanied with many problems,they are rapidly growing.The rational establishment of a multilateral platform legal regulation system will quickly fill the loopholes in the platform and safeguard the development of multilateral platform enterprises.Exploring the common problems of platforms generated by Airbnb can provide reference for most multilateral platforms at this stage.This article will start with Airbnb and briefly compare the legal supervision and regulation between Chinaand the United States on the homestay short-term rental platform of and then discuss the legal regulation of the homestay short-term rental platform.This article also hopes to provide reference for the legal regulation of other multilateral platform companies.This article is divided into four chapters.The first chapter introduces the basic situation of Airbnb and multilateral platform theory.Through the exploration of Airbnb and multilateral platform network effects and critical scale,interpreting the development course of Airbnb multilateral platform,discovering the commonalities and characteristics of multilateral platform enterprises.The second chapter briefly describes Airbnb's challenge and break with the traditional American supervision,and the hotel industry's crackdown on the short-term rental platform.It explores the regulations of the US municipal governments on the short-term rental market and the regulatory and legal regulation of the American hotel short-term rental platform.The third chapter briefly describes the current status of short-term rental industry and platform after Airbnb lands in China,compares the responsibilities of traditional housing agencies and hotels to find the status and defects of China's platform supervision and legal regulation.The fourth part explores the ways to improve the legal regulation of China's homestay short-term lease and multilateral platform by sorting out and comparing China's and the United States' platform supervision and legal regulations.Platform supervision not only needs to strengthen public supervision,improve relevant legislation and industry rules,but also improve itself to strengthen the management and control mechanisms,and improve the internal rating,access,and compulsory insurance service rules of the platform.At the same time,in the era of big data,we must also speed up the construction of the credit system and help the platform to self-regulate and manage.Build a double supervision model of platform economy.
