In recent years,"iPad","You are the One" and other cases involving trademark "reverse confusion",which have caused the media and the public to pay high attention to.However,the trademark law,relevant laws and regulations in our country have not made a clear identification.It has caused the different courts have different attitudes.Obviously,there is no unified understanding of reverse confusion in China.They have a lot of differences between the reverse confusion and the traditional confusion,so some scholars have called for the addition of the reverse confusion into the trademark law or the related regulations as a form of confusing tort.In 2013,the reverse confusion was not written into the trademark law.This article hopes to analyze the basic theory of reverse obfuscation,the difference between the reverse confusion and the traditional confusion,harms of the reverse confusion,the identification standard of the reverse confusion,the examination factors of the reverse confusion in the actual cases in our country.Whether to enter the law,how to identify and consider factors in China's specific recommendations.
