| Illegal interrogation,confession complex and file transcript centralism and so on factors caused or contributed to the problem of "repeated confession".There are two kinds of obstacles,before excluding "repeated confession" : one is careful consideration of all related factors,such as different interrogation personnel,different time interval,different severities,different body and mind of suspects;the other is unfavourable judicial condition,such as self-protection of investigation organ,proving mode of "confirm each other",prosecution claims precedence and so on.In addition,the defenses` claim of "pre-trial confession illegally obtained" are rarely realized.Combined with the external exclusion rules and domestic legislative propositions,this paper`s proposal is Optimizing the judicial environment,Making up for legislative defects,Improving the quality of justice. |
