Research On The Construction Of Legal System Of Disciplinary Punishment

Today's society is a credit society,and credit plays an irreplaceable role in the development of the market economy.However,in recent years,the phenomenon of dishonesty in China has become very common,and it has become a major obstacle to economic development and has become the focus of attention of the whole society.From individuals to enterprises to social organizations,there are different levels of credit deficiencies.Relying on ethical norms to restrict people's inner activities has far failed to achieve the desired results.As a guarantee link in the construction of social credit system,the legal system of dishonesty and disciplinary punishment can not only punish and crack down on the phenomenon of dishonesty,but also effectively prevent the recurrence of dishonesty,which is of great significance for rebuilding the credit society.In order to maintain the stability of social credit relations and ensure the healthy development of the market economy,the legal system of discretion and punishment is urgently needed to be constructed.This paper is divided into five parts to study the construction of the legal system of disciplinary punishment.The first part of the introduction,mainly describes the research background and significance,literature review and research methods.The second part is the necessity and feasibility of the construction of the legal system of punishment for dishonesty.Firstly,it briefly introduces the lack of credit and the punishment for dishonesty.Secondly,it focuses on the analysis of the necessity and feasibility of the construction of the legal system of punishment for dishonesty from the perspective of jurisprudence and combined with relevant cases.The third part is to discuss a series of difficult problems to be solved in the construction of the legal system of dishonesty and disciplinary,analyze the difficulties and obstacles that the legal system will face in the process of construction,and then think about the framework and solution of the legal system.The fourth part introduces and sorts out the practices of the United States,Germany and Japan in the construction of credit information and the construction of disciplinary system,and compares and summarizes their advanced experience in order to seek inspiration for the construction of the legal system of disciplinary punishment in China.Thefifth part is based on the above arguments,the difficulties in constructing the legal system of disciplinary punishment,and through the comparative analysis of foreign related systems,the author puts forward the construction idea of the legal system of dishonesty and disciplinary which conforms to the actual national conditions and has Chinese characteristics: The legal basis for disciplinary punishment;the legal responsibility of the untrustworthy person;the improvement of the system of disciplinary system and the construction of the platform;the improvement of privacy protection and credit relief.The author hopes that through the discussion and research on the construction of the legal system of disciplinary punishment,it can effectively crack down on the subject of dishonesty and disciplinary,thus benefiting the construction of China's social credit system.
