Research On The Design Patent Protection For Graphical User Interface

The graphical user interface is an operating interface for the "interaction",which is displayed in a combination of visual figures and concise text.The position of the graphical user interface in the market economy is gradually rising.Chinese protection of the graphical user interfaces is also undergoing a development process from scratch.Therefore,the research on the graphical user interface protection system has a practical significance.Firstly,according to an analysis of the origin,development,characteristics of the graphical user interface and the current graphical user interface protection mode,the graphical user interface belongs to the results of human intellectual activities,can bring certain economic benefits to the right holders and is an intangible property.By examining the protection mode of the graphical user interface,the possibility that the graphical user interface becomes the protective object of copyright law is fundamentally excluded.Secondly,after the graphical user interface is incorporated into the protection scope of Chinese design patent,it can be found that the graphical user interface and design have some similar aspects in terms of properties and protection objects etc.Finally,on the combination with the revised draft of Chinese Patent Examination Guide,as to problems to the improvement of the graphic user interface protection system in China,the paper proposes to construct a partial industrial design patent system and minimize the definition function of work for the graphic user interface design to improve the industrial design patent system of China,so as to provide comprehensive and accurate protection for the graphical user interface.
