The purpose of setting up special maintenance funds for residential buildings is to repair and rebuild all owners' shared parts and shared facilities after their warranty periods.Since the depositor is the owners,the purpose of the establishment is to protect the use of shared parts and shared facilities,extend the service life of the residential buildings and provide better service to all owners.So,we have always called it a residential pension.Before the reform and opening up,China's housing policy has always been plan allocation.After 40 years ‘ development,it transitioned to a new stage of socialist market allocation with Chinese characteristics.The original model guaranteed by the government has not adapted to the development of the real estate market,today's home repair programs are more affected by market factors and the property owners can decide the specific maintenance and management.In 1990,the Ministry of Housing and Urban-Rural Development promulgated the “Management Measures for Maintenance Facilities Funds for Shared Facilities in Residential Areas” about the concept of shared parts and facilities,the establishment of maintenance funds,the use of maintenance funds,the depositors,the deposit ratio,and the procedures for use.After that,the subsequent "Property Law","Property Management Regulations" and "Management Measures for Residential Special Maintenance Funds" have more specifically supplemented the previous regulations.However,there are still some imperfections in terms of deposit standards,procedures for use,value-added,subject participation and specific procedures for administrative supervision.This article focuses on how participants can achieve a combination of rights and responsibilities in supervision,ensure that the design of the system level is legal and reasonable,solve the original inaction and chaos as a regulatory act,ensure the legitimate rights and interests of each owner and truly play the role of laws and regulations.This paper mainly introduces the concept of the administrative supervision ofresidential special maintenance funds,combines the experience of relevant foreign supervision,and uses the method of field investigation to focus on the investigation of the problems and causes of administrative supervision,and proposes to optimize the administration,in order to achieve the standardization of the administrative supervision of residential special maintenance funds.
