Employee invention is a significant component of the innovation outcome in any country,owing to the enterprise and institution as the innovation subject to improve independent innovation and technological transformation is the key to accomplish the combination with scientific and technological innovation and social development for the purpose of construction of innovation-oriented country.Therefore the study on employee innovation outcome shall not only bring the employee invention reward and remuneration system into full play of protection and encouragement,but give full protection of the employee inventor,so as to achieve the coordinated operation of research and development and the win-win situation.The paper began from the concept and nature of the employee invention and its reward and remuneration,put forward the triple concept and scope,from broad to narrow,the employee scientific outcome,the employee technological outcome and the employee invention,and clarify the nomology foundation and value of its reward and remuneration.Afterward the paper introduced the current situation of employee invention system in China,particularly the influence on the innovation of enterprise and institution by the current system,thus confirm the fact that the current reward and remuneration system of employee invention has either been implemented properly,or played a part in interest balance,and the right and property of inventor has not been fully protected.On that basis,the paper argued the significance of the reform of reward and remuneration system of employee invention,clarify the reform that consists of Law on Promoting the Transformation of Scientific and Technological Achievements,Patent Law and Regulation on Employee Invention as a whole,and concluded the overall system construction of reward and remuneration of employee invention in the future.Regard the comparison with the relevant reform overseas,the inspiration and reference to the reform in China were stated throughout the combination of the static law and regulation and dynamic process of reform.Eventually,the paper evaluated the reform of reward and remuneration system of employee invention from the perspective of validity,rationality and legitimacy.In this regard,the writer proposed the corresponding suggestions on the system structure and routing,expecting to be consultative opinions for the reform of reward and remuneration system of employee invention in the future.
