The Research On The Formulating Procedure Of Non-legislative Administrative Normative Documents

Non legislative administrative normative documents are made by governments according to the legal authority to administer laws and regulations with universal binding force within a certain period of time,which are related with citizen,legal person or other organization’s rights and obligations.At present,the formulating procedure of non-legislative administrative normative documents haven’t been made clear by laws and regulations yet,and there are still problems in governments’ daily operation.This paper sorts out concepts of non-legislative administrative normative documents mentioned in laws,regulations,judicial interpretation as well as the role in the practice and explanation of laws and regulations.Through the research on 2807 documents released by S city Commission of Health and Family Planning from 2013 to 2015,the author find out problems in formulating procedure,such as single form of starting program,weak strength of legal review,high cost in process.Aiming at these problems,the author puts forward three types of criteria for classification based on the adjustment objects of non-legislative administrative normative documents.They are special,important and general ones.And also,the author designs three procedures for three types of documents in order to provide valuable reference for governments.They are special,general and simple ones.
