The Blance Between Imputability Of The Self And Reliance Rationality Of The Opposity Party In Apparent Agency

The regulations of apparent agency have been written into the Contract Law of article 49 in our country,which states that “the opposite party has reasonable ground to believe that the actor has dealership”.But from the interest balance and social equality,we also need to investigate the imputability of the self to make sure the reasonable reliance of the opposite party.The imputability can be divided into different types and has a uneven height degree,in the meantime,the reliance rationality has the same characteristics with the imputalility.To build the balance frame between the imputalility of the self and the reliance rationality of the opposite party,we should analyze the two subjects from the different degree level,than we can judge the constitutive requirements of apparent agency.In the final,we can apply this legal system to the practice more precisely.
