Reflection And Reconstruction Of Reward Notice System In China

With the complexity of social security situation and the concealment of criminal means,public security organs need more and more help from the public when handling relevant cases and carrying out social security control.Police-civilian cooperation has become an important part of the comprehensive management of social security.As an effective carrier to implement the working principle of "combining specialized organs with the masses",Reward Notice play an increasingly important role.It can not only expand the information channels of public security organs and improve the efficiency of handling cases,but also deter criminals and prevent crimes.However,China's Reward Notice system is not perfect,there are a lot of legal gaps.The absence of rules not only restricts the function of Reward Notice,but also buries the hidden danger of disputes between public security organs and actors.In order to regulate the use of Reward Notice and protect the legitimate rights and interests of actors,it is necessary to improve our Reward Notice system.This paper mainly uses comparative study,case study and other methods to summarize the legal problems existing in the practice of Reward Notice in China.It is concluded that the nature of Reward Notice is not clear,the subject of reward notice is not clear,the application situation is not clear,the source of reward is not guaranteed,the amount of reward is unreasonable,and the rules of reward payment are missing.The key to solve the problem lies in the determination of the legal nature of Reward Notice,which determines the applicable law of Reward Notice and the legal remedy method of actors.In my opinion,Reward Notice is essentially an administrative promise and belongs to the category of administrative act,so it is different from Private Cash Reward.On this basis,in view of the above questions,we should improve the system design of Reward Notice,strengthen the protection of the legal rights and interests of the actors,in order to ensure the maximum realization of the effectiveness of Reward Notice system.
