Research On The Examination System Of Criminal Appraisal Of Procuratorial Organs In China

Authentication opinion itself is unique,and plays a significant role in investigating a suspect’s criminal responsibility.Except for fundamental requirements of evidence law,authenticationopinion also includes theory,science,technology and many other categories of expertise.The complexity of professional and the finiteness of review personnel’s cognitive ability forms enormous contract,so that effective inspection is difficult to be carried out in judicial practice solely from a technology perspective of science and law.However,the procuratorial organ is the organ of legal supervision inour inspection constitution,conducting legal supervision of the whole process of criminal litigation.In its performing duty process,naturally includes the supervision to the judicial expertise.Under the perspective of the New Criminal Procedure Law,combining the relevant knowledge of Litigation Law and Forensic Sciences,as well as the functions and work practice of procuratorial organ,this article exploresthe Chinese censorship of the criminal forensic conclusions in the procuratorial link.Presented first is the concept,essential attribute and characteristicsof criminal authentication opinion,and the necessity of inspection.In the second place,conducting analysis of inspection rules of criminal authentication opinions in procuratorial link.Finally,on the basis of aforementioned theoretical research,analysis is carried out in the existing problems of authentication opinion inspection in procuratorial link.Suggestions are also put forward for improving this censorship aimed at structuring applicable censorship for procuratorial organ for deepening judicial system reform in our country.
