Research On Women’s Property Rights In Qing Dynasty

In the traditional social concept of "men are superior to women" in the Qing dynasty,did women own personal property or property rights? In this paper,by analyzing the rules of law,the judicial records,in Qing dynasty,folk customs,such as data,found in the legal concept of the Qing dynasty,women in the social and family plays a very important role,in a traditional society "cohabitation total goods" in the family property system and can still have “Personal property”,such as a dowry this property completely independent of the family property,by the free woman.In addition,under many conditions,the law stipulates that women have a certain right of inheritance.Women’s property rights and other rights related to property rights play an important role in women’s family life.In the society where the traditional Confucian ethics prevailed in ancient China,women were in a weak position.The law had certain relief and safeguard measures for women,but it still needed to be improved.Women’s mastery of property rights reflects the development level of social commodity economy and has a certain impact on the traditional concept of propriety and law.In the Qing dynasty,the overall level of labor force was low,and the decadent feudal ideology was deeply rooted in people’s hearts.Women play different roles in the family,and their status has a significant impact on the control of property rights.When women are in the roles of daughter,wife and mother,their authority to manage property gradually increases.Through the analysis of women’s property rights,it is found that the factors affecting women’s legal status are not only economic basis,but also ideology and legal system.By analyzing the legal status of women in the connotation of traditional Chinese legal culture,this paper reconstructs the real picture of legal culture in the Qing dynasty society,studies the property rights and status of women’s roles in the Qing dynasty society,and explores the development path of modern women in the historical investigation.
